Recently, we met to discuss the above-captioned dispute, as remanded by Arbitrator Margo R.
Newman, dated August 13, 2025, at the fourth step of our contractual grievance procedure.
Time limits were extended by mutual consent.
After reviewing this specific case, the parties agree to the following:
All affected employees shall be compensated for the difference in pay between the level and
pay rate they were returned to and the level and pay rate they would have earned in the
“pending qualification” detail, pursuant to Article 38.5.C.3 of the collective bargaining agreement.
Step increases will be calculated from the effective date of when the employee was considered
promoted while pending qualification and will be considered a continuous period, ending when
the employee elects to remain in their current duty assignment or return to their prior duty
assignment, consistent with the election process described below.
All affected employees (including those that have since retired from the Postal Service) shall be
made whole, consistent with the foregoing and in a manner that is not detrimental. Any remedy
previously issued to an affected employee in connection with resolution of this issue at another
step of the grievance-arbitration procedure will be considered in the calculation of the make
whole remedy. Any discrepancies concerning the make whole calculations will be escalated to
and discussed by the national level parties on a case-by-case basis.
The make whole remedy shall include all applicable contractual premium payments, including
out of schedule premium, if/where applicable/warranted.
All affected employees shall be immediately returned to the prior duty assignments,
occupational groups, and levels, they were placed into, as when treated as promoted pending
qualification, pursuant to Article 38.5.C.3 of the collective bargaining agreement, unless an
affected employee elects in writing to remain in their current duty assignment, occupational
group, and level.
Within thirty (30) days of the execution of this agreement, the Postal Service shall provide
written notice to each of the forty-two (42) affected employees identified on the attached list,
with a copy to the National APWU Director, Maintenance Division, advising the employee of: (a)
the duty assignment, occupational group, and level to which they employee would be returned;
(b) the right to elect to remain in the employee’s current duty assignment, occupational group,
and level; and (c) the procedure and deadline for making such election.
An affected employee electing to remain shall do so by submitting a written election to the
USPS Director, Contract Administration (APWU}, with a copy to the National APWU Director,
Maintenance Division, no later than ninety (90) days after receipt of the Postal Service’s notice.
Within fifteen (15) days following the close of the election period, the Postal Service shall
provide the National APWU Director, Maintenance Division, with a list identifying each affected
employee, the employee’s election (return or remain), and the effective date of return for those
returning.
For employees who elect to return, the backpay differential set forth above will cease to accrue
as of the effective start date of the position to which they are returned.
For employees who elect to remain, the backpay differential set forth above will cease at the
conclusion of the election period.
Any employee who fails to submit a written election as described above within the ninety (90)
day election period shall remain assigned to the employee’s current duty assignment,
occupational group, and level, in lieu of return, and the backpay differential set forth above shall
cease to accrue upon expiration of the ninety (90) day election period.
In addition, any local grievance held pending this national dispute will be processed in
accordance with this agreement.
The signing of this agreement constitutes full and complete settlement of the subject dispute
and resolves all issues pertaining thereto and will not be cited by either party in any subsequent
grievance/arbitration hearing or in any other proceeding in any forum except for enforcement of
its terms.
