The issue in this grievance is whether local management must provide the grievant with hypo-allergenic ear plugs. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We agreed that if the grievant has suffered from an occupational disease, then this complaint should be processed in accord with ELM 542.12. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing including arbitration, if necessary.
