The question in this grievance is whether or not management at the Troy, Michigan post office violated Article XIX of the National Agreement by requiring the grievant to distribute mail using the MO-MIP method. in our view this grievance does not fairly present a nationally interpretive question.
A review of the grievance file disclosed that the grievant was sent for a fitness-for duty examination because she stated that she could not physically perform MO-MIP distribution. The physician suggested a slight modification and management cooperated by implementing the suggestion for the grievant. Under these circumstances, it is our position that management took the appropriate action to resolve this grievance. This case is hereby remanded to Step 3 who will ensure that the above provision is followed and the mailer’s compliance is monitored by local officials.
