The issue in this grievance is whether the grievant was properly placed on Restricted Sick Leave status. After further review of this matter, we mutually agreed that no national interpretive issue is fairly presented as to the meaning and intent of Articles 10 and 19 of the National Agreement. This case is a purely factual dispute over the application of Subchapter 513.37 of the Employee and Labor Relations Manual (ELM). Therefore, this dispute is suitable for regional determination. Accordingly, as we further agreed, this case is hereby remanded to the parties at Step 3 for further development and consideration, if necessary, by the parties.
