The issue in this grievance is whether management properly returned the grievant to the restricted sick leave list. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. This is a local dispute suitable for regional determination by application of Part 513.37 of the ELM to the particular circumstances. The parties at this level agree that the provisions of Part 513.37 of the ELM must be followed whenever an employee is placed on the restricted sick leave list. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
