The issue in this grievance is whether medical records are being properly reviewed and/or maintained. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. Further, we agreed that whether the medical records are being reviewed and/or maintained in accordance with regulations is a matter suitable for regional determination based on the local fact circumstances. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
