The issue in this case is whether the disputed duty assignment should be reposted due to the incumbent's detail to a 204-B position. After further review of the matter, we mutually agreed that there was no national interpretive issue fairly presented as to the meaning and intent of Article 37, Section 3.A.7 of the National Agreement. The parties at this level agree that:
1. Temporary details to supervisory positions must be consecutive to require a duty assignment to be declared vacant.
2. PS Form 1723 should be prepared indicating actual dates and times of the detail.
3. PS Form 1723 will be promptly provided to the Union at the local level.
The determination of whether the disputed duty assignment should be declared vacant is a fact dispute suitable for regional determination. Accordingly, as we further agreed, this case is hereby remanded to Step 3 for further development and consideration if necessary by the parties.
