This Step 4 Settlement Agreement addresses whether management has the authority to require a bidder or bidders for a senior qualified position to submit written qualification descriptions, beyond the information required on PS form 1717 prior to the close of the bidding cycle. After reviewing this matter, the parties agreed that on remand, Section 174 of EL 303, Use of Qualification Standards in filling Vacancies, and National Arbitration Case H4C-1M-C 4025 should be controlling in resolving this issue. Accordingly, the parties agreed to remand this case to Step 3 for further processing, including arbitration if necessary.
