This Step 4 Settlement Agreement involved whether the grievant was improperly denied a bid on an MPLSM position. The parties mutually agreed that there was no National interpretive issue fairly presented as to the meaning and intent of Article 37, Section 3.F.4.C of the National Agreement. However, it was agreed that the circumstances of the case must be reviewed and evaluated, and that the length of time since the, last failure to complete the prescribed training successfully; the point in the training where the failure occurred; the cause of the failure; and whether the reason for the prior failure continues. Accordingly, the parties further agreed to remand this case to Step 3 for further development and consideration, to the extent discussed above.
