This Step 4 Settlement Agreement involved whether or not management violated the National Agreement by denying the grievant a Distribution and Window Clerk job due to her hearing impairment. During the discussion, the parties mutually agreed that the grievant would be provided appropriate combinations of training, testing, and practical demonstration of ability to perform in a Distribution and Window Clerk position. In doing so, management would take suitable steps to ensure that reasonable accommodation is made in providing the training. It was also agreed that should the grievant satisfactorily complete the training and, with or without reasonable accommodation, be able to satisfactorily perform the duties of the job, she would be placed into the job.
