The issue in this grievance involves when the grievant was restricted from further bidding. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. The parties at this level agreed that the grievant was restricted from further bidding as of September 10, 1988, the date of her promotion to Distribution Clerk, Machine as reflected on the Personnel Action, PS Form 50. We further agreed that the grievant would be considered live on a bid submitted prior to that date, provided she was fully qualified as of September 10, 1988, and provided she notified management of her intention to remain a bidder pursuant to Article 37.3.F.8. Accordingly, we agreed to remand this case to the parties at Step 3 for application of this agreement.
