During our discussion we mutually agreed that there is no interpretive issue involved in this case as no dispute exists between the parties with respect to the intent of the language in Article VIII, Section 5, of the National Agreement. In the instant case, the grievant, by virtue of his assignment and tour, was not otherwise available for the overtime work in question and was not, therefore, entitled to the overtime assignment. Accordingly, as we further agreed, this case is hereby remanded to step three or processing by the parties at that level.
