The question in this grievance is whether or not management violated Article VIII of the National Agreement in this case when carriers were used on overtime to perform clerk craft duties because clerks on the Overtime Desired List have been limited to eight (8) hours when working on their non-scheduled days. We mutually agreed that the reasons provided by management for using carriers in this case do not justify their use. Clerks on the Overtime Desired List have an obligation to work overtime when it is required, even up to ten (10) hours, and management has an obligation to offer it first to clerks when it is in the clerk craft. We, therefore, agreed that if the grievant, who is on the Overtime Desired List was available at the appropriate time for the overtime opportunity, and had the necessary skills, it should have been offered to him prior to using employees in the carrier craft. If the facts above bear out, the grievant shall be compensated for being improperly bypassed for two (2) hours overtime on the day in question.
