This USPS Step 4 Denial outlines Management's position on whether management violated Article 37 of the National Agreement by not awarding the grievant a Bulk Mail Clerk assignment. In this case, the grievant failed to qualify on training for a position identical to the one which he was denied. The second position became available on the day that he failed to qualify. Considering the circumstances, the Postal Service found no contractual violation and the grievance was denied.
