Parties’ 6-13-90 Memorandum of Settlement require that no employee would, as a consequence of promotion, at any time be compensated less than the employee would have earned if the employee had not been promoted. The Arbitrator concluded that TCOLA must be included in those lump sum calculations. NOTE; APWU 1999 CBA eliminated the anomaly for APWU-represented employees.
