Step 4 Settlement Agreement: Article 1.6; Supervisors performing bargaining unit work (1989)

The issue in these grievances is whether management has violated Article 1.6 of the National Agreement when it completed ODIS forms and/or tests.  After reviewing this matter, the parties mutually agreed that no national interpretive issue is fairly presented in these cases.  With the advent of new ODIS testing technology and procedures, the forms and tests that are at issue in these grievances are no longer used.  Therefore, any possible interpretive issue had been mooted. Accordingly, the parties agreed to remand these cases to the parties at Step 3 for further processing, and application of the Snow Award AC-N-6922, including arbitration if necessary.
