The issue in this case is whether an employee on the Overtime Desired List could decline to work more than two hours of overtime on a scheduled workday. In the instant case the grievant was offered 2 1/2 hours of overtime. He was willing to work two hours only and management bypassed him going to the next employee on the Overtime Desired list. Based on the facts of this case and the pre-arbitration settlement between Mr. James Merrill of the Postal Service and Mr. Emmet Andrews of the APWU signed in 1975, it was mutually agreed to full settlement of this case as follows: The grievant will be compensated for two hours of pay at the straight time rate that was applicable at the time of the dispute.
