Step 4 Settlement Agreement: Article 37.3.A.8; Posting, Bidding, and Application (1983)

The question raised in this grievance involved whether the assignment occupied by a 204B detailee should have been posted. After further review of this matter, we mutually agreed that no national interpretive issue is fairly presented in the particulars evidenced in this case. We agreed that temporary OIC assignments are included in the temporary supervisory assignments referenced in Article 37.3.A.7. We also agreed that whether the detailee was in a temporary supervisory assignment in excess of four months is a question that can only be answered by evaluating the fact circumstances involved. Accordingly, as we further agreed, this case is hereby remanded to the parties at Step 3 for further processing, if necessary.
