This Step 4 Settlement Agreement addresses whether management was proper in not reposting for bid a duty assignment, when the senior bidder failed to qualify during the deferment period. After further review of the matter, the parties mutually agreed that when the deferment period expires, and there is no “senior bidder then qualified”, then the duty assignment becomes a residual vacancy. The parties further agreed that Management is not obligated to repost residual vacancies, and accordingly, closed this case based upon this understanding.
