The issue in this grievance involves a local policy which requires the supervisor to accompany an employee, who has been injured on-the-job, on the first visit to the doctor in virtually every circumstance. During our discussion, we mutually agreed that in view of the Step 4 settlement in case H1C-1E-C 16915 regarding the same issue, we shall also resolve the instant grievance. According to Part 543.13 of the ELM, a supervisor accompanies an employee needing emergency treatment to the doctor's office or hospital, when appropriate, to make certain that the employee receives prompt medical treatment. However, Part 543.223 of the ELM provides that a supervisor is not authorized to accompany the employee to a medical facility or physician's office in non emergency situations. The intent of the local instruction must not conflict with the ELM provisions. Accordingly, we agreed to remand this case to Step 3 for application of the above understanding.
