The issue in this grievance is whether management is improperly maintaining an adverse action file on employees. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We agreed that this issue is proper for regional determination based on the facts involved and application of appropriate regulations including ELM Chapters 313 and 314. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing including arbitration if necessary.
