After reviewing this matter, it was mutually agreed that no national interpretive issue is fairly presented in this case, and whether local management properly applied the provisions of Part 350 of the Administrative Support Manual in citing the grievant's past safety record could only be determined by evaluation of the fact circumstances. Accordingly, the parties agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
