The issue, in this grievance is whether management properly denied Level 4 employees the opportunity to bid on a Level 5, Flat Sorting Machine position. After further review of this matter, we agreed that there was no national interpretive issue fairly presented as to the meaning and intent of Article 37 of the National Agreement. This is a local dispute over the application of Article 37, Section 3.A.9, of the National Agreement. We agreed that Level 5, FSM positions are not listed in Article 37, 3.A.9.C. Therefore, Level 4 employees are restricted from bidding, as provided by Article 37, 3.A.9. The parties at Step 3 should apply the above understanding in order to resolve this case. Accordingly, we agreed to remand this case to Step 3 for further processing as identified above.
