This Step 4 Settlement Agreement is where the parties mutually agreed that there was no interpretive dispute between the parties at the National level as to the meaning and intent of Article 37 of the National Agreement, as it relates to filling preferred duty assignments where incidental typing is required. Article 37, Section 3.F.6., states that where incidental tying is required as part of a duty assignment, such requirement must be reasonably related to the efficient performance of the responsibilities of the job. It was understood that where a typing requirement is contractually proper, a senior bidder may be required to demonstrate his/her skill by passing an appropriate typing test, if he/she is not already on a typing register. Whether or not, in this case, the typing requirement was reasonably related to the efficient performance of the job was a matter to be determined by examination of the local fact circumstances.
