This Step 4 Settlement Agreement addresses whether or not management violated Article 37, Section 3.F.7, of the National Agreement when the second senior bidder for a SSPU Technician vacancy was not given the opportunity after the bidding was completed to pass the required examination. The SSPU Technician position was inadvertently omitted from the list of positions in Article 37, Section 3.F.7, in both the 1978 and 1981 National Agreements. However, Postal Bulletin 21166 dated November 30, 1978, added the SSPU Technician position to the list in Article 37, Section 3.F.7. Therefore, this position must be filled in accordance with the provisions outlined in Article 37, Section 3.F.7, of the National Agreement.
