This Step 4 Settlement Agreement addresses whether or not management violates Article 37 of the National Agreement as it relates to the establishment of Relief/Pool assignments. The Union felt that management was improperly using the grievant as a relief clerk in that his job description did not clearly distinguish him as a relief clerk and he is not relieving on the types of assignments specified in the National Memorandum of Understanding. In their joint opinion, the bid position which was held by the grievant, did not clearly distinguish this position is a Relief/Pool assignment, however, they had received information that the position was established in 1978 by agreement between the parties at the local level as a relief assignment.
