The question in this grievance is whether or not management violates Article VIII of the National Agreement by voiding the Overtime Desired List as presently administered in this local office. The list for clerks was posted with columns for before tour, after tour, and non-scheduled days. This procedure was agreed to during local negotiations. Local Management has now determined that the agreement is in direct conflict with the National Agreement. We do not find the above procedure to be in a direct conflict with the National Agreement and local management is directed to return to the negotiated procedure by the beginning of the next quarter after receipt of this decision. We do not see any requirement for penalty compensation as employees are still offered opportunities for overtime by seniority.
