This Step 4 Settlement Agreement addresses whether the grievant properly submitted documentation to support her absence due to illness. The parties mutually agreed that whether the grievant provided acceptable documentation in accordance with the provisions of subchapter 513.364 of the Employee and Labor Relations Manual (ELM) was a factual dispute, rather than an interpretive one. However, the parties at Step 4 agreed that a naturopath is considered an "attending practitioner" under ELM 513.364. Accordingly, it was agreed to remand this case to the parties at Step 3 for further processing, if necessary.
