Return to Contract DatabaseThis USPS Step 4 Denial outlines Management’s position on whether local management violated the National Agreement by denying the grievant a Bulk Mail Clerk position because of deafness. It was the Postal Service’s position that no national interpretive issue involving the terms and conditions of the National Agreement was fairly presented in this case. Inasmuch as the union did not agree, the decision of the Postal Service found no contractual violation; that local management determined that the grievant did not meet the physical requirements of the position; and that nothing had been presented which would justify disturbing that determination.
