The issue in this grievance is whether a certified Tour 3 shop steward is being denied the right to function on his assigned tour in accordance with the provisions of Article 17, Section 2(a), of the National Agreement. During our discussion, we mutually agreed that no national interpretive issue is fairly presented in this case. There is no dispute between the parties as to the language set forth in the above-referenced section of the National Agreement. We further agree that stewards have the right to represent employees in specific work locations on their tour. Moreover, we concurred in the view that a steward whose tour of duty starts at 6:00 p.m. and ends at 2:30 a.m. has the right to represent employees working within his tour (whom he has been certified to represent in accordance with Article 17, Section 2(A), of the National Agreement). This certification shall be in accordance with the formula specified in the National Agreement.
