The issue in these grievances is whether the grievants were improperly denied the disputed positions. The facts in our respective case files indicate that effective May 20, 1979, six full-time regular clerks were reassigned from Hazleton, Pennsylvania, to Wilkes-Barre, Pennsylvania. The excessing of these clerks from Hazleton to Wilkes-Barre had been discussed on several occasions with local union representatives. On August 14, 1979, three of the former Hazleton clerks were awarded local Wilkes-Barre duty assignments pursuant to local bidding in accordance with Article XXXVII. The union contends that the disputed duty assignments were improperly awarded because the excess clerks should have been precluded from bidding or 180 days in accordance with Article XII, Section 5(C)6.
