The issue in this grievance is whether the grievant is entitled to an eight-hour guarantee for time spent undergoing a Fitness-for-Duty Examination. The facts in this case indicate that the grievant's regular tour of duty is 2:00 p.m. to 10:30, Tuesday through Saturday. On Monday, April 18, 1983, the grievant was required to undergo a Fitness-For-Duty Examination. The union contends that the grievant is entitled to an eight-hour guarantee under the provisions of Article 8, Section 8.B, of the National Agreement. It is the position of the Postal Service that the grievant is not entitled to an eight-hour guarantee under the circumstances present in this case. Article 8 guarantees are only applicable to work situations. The grievant was not called in to perform any work. It should be noted that the grievant was compensated at the overtime rate for the time spent undergoing this examination.
