The evidence presented indicate that the grievant in this instance is entitled to court leave as a result of being subpoenaed by the District Court of Massachusetts to be a witness for the State. To this extent the grievance is sustained. The grievant will receive court leave tor the time necessary to appear as a witness in lieu of annual leave.
