The question in this grievance is whether an administrative EEO case can be settled in a manner that is contrary to the provisions to the National Agreement. During our discussion, we mutually agreed:
Equal Employment Opportunity settlements may not take precedence over the language contained in the collective bargaining agreement. Accordingly, the parties at Step 3 are to determine if the employee was properly detailed to the subject position in accordance with the contractual provisions of the National
Agreement.
