The issue in this grievance is whether a Step 1 grievance resolution was properly implemented. After further review of the matter, we mutually agreed that there was no National interpretive issue fairly presented as to the meaning and intent of Articles 15 and 16 of the National Agreement. In accordance with Article 15, Section 2, Step 1(b), the supervisor shall have authority to settle the grievance. In this case, the steward and the Step 1 supervisor reached an agreement on how to settle the grievant's discharge grievance. The provisions of that settlement are in dispute. As such, the determination of what was agreed at Step 1 is a fact determination to be made at the regional level. Accordingly, as we further agreed, this case is hereby remanded to Step 3 for further development and consideration if necessary by the parties.
