During this Step 4 Settlement Agreement, the parties agreed that there is no interpretive dispute between the parties and the National Level as to the meaning and intent of Part 415.111 (DMM915-PSM166-Special Postal Bulletin 21203, 8-10-79) concerning when special delivery trips must begin. It was agreed that the 0600-0800 special delivery trip beginning time frame was a guideline which was to be normally followed. If this time frame was not followed, management must be able to demonstrate that unique fact circumstances existed which justifed an earlier or later special delivery trip beginning time. Accordingly, as further agreed, this case was hereby remanded to Step 3 for further processing by the parties at that level based upon the fact circumstances involved. Management was to explain to the Union's Step 3 designee, the unique fact circumstances which necessitated the later than 0800 special delivery trip beginning time. If unique fact circumstances did not justify the later than 0800 special delivery trip beginning time, management was to change the subject special delivery trip beginning time to conform with the agreed to interpretation of the above cited regulations.
