This issue in this grievance is whether Part 517.7 of the Employee and Labor Relations Manual (ELM) allows for the granting of change of schedule mutual trade of days off for employees who have official duty orders or official notices signed by appropriate military authority for weekly, biweekly, or monthly training meetings, which occur on weekends, and who have a conflict with scheduled work requirement. During our discussion, we mutually agreed to close this case based on the following:
The language of ELM Parts 517.71 and 517.72 are intended to allow the trading of work days and days off or the changing of an employee's schedule to avoid conflict between military duty and any day(s) the employee is scheduled to work. This also applies to weekend drills or training.
Any such reschedulings and/or mutually agreeable trades for military training meetings will be accomplished in accordance with ELM Parts 517.71.d and 517.72. (Step 4 Agreement dated 09/14/1989).
