The question in this grievance is whether or not management violates Article X of the National Agreement with regard to Administration of the Court Leave Provisions of Part 516 ELM. The grievant's normal schedule at the time of this grievance required her to work on Sundays. She was summoned for Court service from April 27, 1981 thru May 14, 1981. She was not paid Sunday premium for the Sundays included in this period. The Union requests that she be paid. Information received from local management reveals that the grievant changed her schedule to a Monday-Friday workweek to comport with the Court schedule. She did not work or perform Court service on any Sunday. Court leave is authorized under the circumstances only during the Monday-Friday workweek. Sunday premium is not authorized.
