The issue in this case is whether management violated Article 8, Section 5, by assigning overtime work in the maintenance craft to a clerk not on the overtime desired list. The matters presented by you as well as the applicable contractual provisions have been reviewed and given careful consideration. Our respective case files indicate that the local office did not have any available maintenance craft employees to perform the custodial work. The grievant.was on the clerk craft overtime desired list. The employee used to perform the overtime work was a clerk not on the overtime desired list. It is our mutual understanding that overtime desired lists are established by craft, section or tour in accordance with Article 8, Section 5.B. Therefore, under the circumstances present in this case, recourse to the clerk craft overtime desired list was not contractually mandated.
