The issue in this grievance is whether a union representative is required to obtain a signed release when requesting medical information as an authorized union representative while acting in an official capacity. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We further agreed that this issue is suitable for regional determination based upon the particular fact circumstances of the case and the application of EL-806, Section 223.3. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
