The parties mutually agreed that the employees cited would be provided rate protection for three years affective the next pay period subsequent to the date of this decision. However, the employees listed must continue to apply or bid for positions in their former grade level during this period in order to retain their protection. This settlement is without precedent and without prejudice to the position of either party, and it may not be cited by either party in any future grievance, hearing, arbitration, or for any other purpose.
