This Step 4 Settlement Agreement involves whether management violated provisions of the National Agreement in not awarding the grievant the assignment with which this grievance is concerned.  The parties jointly agreed that whether the decision, that the grievant was not qualified to perform the duties of the assignment in question, was proper or not will turn on the fact circumstances in this particular case.  Accordingly, the parties further agreed to remanded this case to Step 3 for further processing if necessary by the the parties.
