This Step 4 Settlement Agreement involved whether a contractual violation occurred when a vacant ET-9 position was filled by transferring in an ET-9 from another office. After reviewing this matter, the parties mutually agreed that whether the ET position in question was properly filled was a noninterpretive issue to be decided based on the fact circumstances. Accordingly, the parties agreed to remand this case to the parties at Step 3 for further processing including arbitration if necessary.
