The question raised in this grievance involves whether under the terms of the Healy Award on Article VI, the grievant is a "protected employee" for involuntary layoff purposes.  Upon review, it is our determination that the grievant is a "protected employee" for lay-off purposes as he was a member of the regular workforce on September 15, 1978, the date of Arbitrator Healy's award.  The fact that he resigned and was subsequently reinstated has no bearing on his protected status.  Upon receipt of this decision, the local office shall initiate the necessary actions to assure that the grievants records reflect his protected status.
