This Step 4 Settlement Agreement involves whether or not management violated the National Agreement by denying the grievant a Distribution and Window Clerk job due to her hearing impairment. During the discussion, the parties mutually agreed to settle this case as follows:  1) The grievant will be provided appropriate combinations of training, testing, and practical demonstration of ability to perform in a Distribution and Window Clerk position.  In doing so, management will take suitable steps to ensure that reasonable accommodation is made in providing the training.  2) Should the grievant satisfactorily complete the training and, with or without reasonable accommodation, be able to satisfactorily perform the duties of the job, she shall be placed in the subject job.  The terms of this settlement are non precedential, non citable, and apply only to this case.
