The issue in this grievance is whether the release of employee's CA-17 to the union is a violation of the Privacy Act. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. The question in this case requires application of ASM 353.326 and Appendix B (P-45) 120.098. The following pertain to Personnel Records - Office of Workers' Compensation Programs (OWCP) Record Copies 120.098:
Pursuant to the National Labor Relation Act, records from this system may be furnished to labor organization upon its request when needed by that organization to perform properly its duties as the collective bargaining representative of postal employees in an appropriate bargaining unit. Whether the CA-17 can be released to the union can be determined at the regional level. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
