The issues in this grievance are its timeliness and whether or not management properly reassigned the cited employee under the Rehabilitation Program provisions of subchapter 546 of the ELM. After reviewing this matter, we mutually agreed that no National interpretive issue is fairly presented in this case. Whether or not the grievance was timely filed is the threshold issue to be determined. If timely filed, the merits of the case will be reviewed. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
