The issue in this grievance is whether or not management properly reassigned the cited employee under the Rehabilitation Program provisions in Subchapter 546 of the ELM. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. Whether or not the rural carrier was properly reassigned to a full-time clerk is a local dispute suitable for regional determination based upon the particular circumstances. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
