The issue in this grievance is whether the duties of an abolished position are being performed by a rehab employee in violation of the National Agreement. After reviewing this matter, we mutually agreed that no national interpretive issue is fairly presented in this case. We agreed that the question raised can only be determined based on the facts involved and with attention to ELM 546. Accordingly, we agreed to remand this case to the parties at Step 3 for further processing, including arbitration if necessary.
