The question raised in this grievance is whether management is obligated to place a rehabilitated employee in the same pay level when reemployed. After further review of this matter, we mutually agreed that no national interpretive issue is fairly presented in the particulars evidenced in this case. The parties agree that management is not obligated to place the subject employee in their former salary level. However, priority consideration must be given to reemployment of the individual into their former position or an equivalent one, as provided by ELM 546. The parties at Step 3 should apply the above understanding to the specific fact circumstances of this case in order to resolve the grievance. Accordingly, as we further agreed,this case is hereby remanded to the parties at Step 3 for further processing if necessary.
